8:30 - 9:00 AM: Welcome and Legislative Update

9:00 – 10:15 AM: Group Session #1: Reducing Legal Risks: Equal Pay, Discrimination and Retaliation Guidelines Overview of state and federal developments pertaining to equal pay, discrimination, and retaliation claims, including relevant cases, to provide guidance on how employers can maintain compliance and reduce their risk of such claims.

10:15 – 10:30 AM: Break

10:30 – 11:45 AM: Group Session #2: The Regulatory Rundown: Review of all of the Final Rules issued for IC, PWFA and Non-Competes; proposed rules for white collar exemption. Discussion of new rules and regulations pertaining to 1) independent contractors, 2) pregnancy in the workplace, 3) non-compete agreements, and 4) exemptions to overtime pay requirements of the FLSA, and the best practices to avoid significant financial liability.

1:30 – 2:30 PM: Breakout Session #1A: Fact-Finding Framework: Conducting investigations of employee misconduct and claims of harassment Answering the questions on when, who and what to investigate including guidance on confidentiality, questioning, and reaching a conclusion. Our panel of experts chart the course for a thorough and defensible investigation.

1:30 – 2:30 PM: Breakout Session #1B: Charting New Paths: New guidance from the EEOC on sexual orientation and gender identity accommodations In Bostock v. Clayton County, Georgia, the Supreme Court held that firing individuals because of their sexual orientation or transgender status violates Title VII’s prohibition on discrimination because of sex. The HCRC and EEOC has taken the position that employers may not deny an employee equal access to a bathroom, locker room, or shower that corresponds to the employee’s gender identity. Panelists will discuss new EEOC guidance on harassment and recent case law.

2:45 – 3:45 PM: Breakout Session #2A: The NLRB and Their Influence on Your Business Practice: Quickie elections, work regulations, joint employers and the impact of Cemex and Stericycle New standards for requiring employers to bargain with unions. Changes to the joint employer standard. The National Labor Relations Board (NLRB) has been busy, issuing several key rulings and interpretations over the past year. Our experts discuss the impact on Non-Union and unionized employers.

2:45 – 3:45 PM: Breakout Session #2B: Remote Realities: Tax labor law implications of remote workers out of state and out of the country Our experts discuss tax, labor law and I-9 verification implications of remote workers who work from out of state and out of the country, including recent updates to state and federal laws, rules and regulations, and relevant cases, to provide guidance on how employers can maintain compliance with said laws, rules and regulations, and reduce their legal risks of related claims.
