Mahalo!\n\n\n\nRegister now for our Hawaii Equal Pay Compliance Webinar on Thursday\, October 5 from 10:00 - 11:00 a.m.\n\n\n\nAct 203 of the 2023 Hawaii State Legislature requires private and state employers with 50 or more employees to disclose in certain job listings the hourly rate or salary range that reasonably reflects the actual expected compensation.  The Act prohibits private and state employers with one or more employees from discriminating between employees because of any protected category by paying them different wages for substantially similar work.  The deadline for compliance is January 1\, 2024.\n\n\n\nAll Hawaii private and state employers will need to determine which jobs involve substantially similar work requiring equal skill\, effort\, and responsibility and are performed under similar working conditions.  They must ensure that any pay differentials between employees performing substantially similar work result from a seniority system\, merit system\, system measuring earnings by quantity or quality of production\, bona fide occupational qualification\, and/or any permissible factor other than a protected category.\n\nCovered employers with 50 or more employees must publish the wage rate and salary ranges in job listings\, unless they involve internal transfers or promotions within a current employer or public employees whose salary\, benefits or other compensation are determined by collective bargaining.\n\n\n\nAttend an hour-long remote briefing on October 5\, 2023 at 10:00 to 11:00 a.m. to cover the need for private and state employers in Hawaii to promptly analyze all jobs\, document each job's required skill\, effort\, responsibility and working conditions\, determine when the jobs may be substantially similar\, establish a pay schedule based on permitted differentials\, increase wage rates or salaries that may violate Act 203\, and if the employers have 50 or more employees\, publish the wage rate and salary ranges not covered by public bargaining agreements in their external listings.\n\n\n\nJeffrey Harris from Torkildson Katz and Kristie Iacopetta and Chase Fleming from Seyfarth's New York and Los Angeles offices will provide this timely briefing.
